(A)
Services
i. Remote Access
TecSmarts, LLC ("TecSmarts") offers remote
access service to assist in diagnosing and resolving
system issues. This process allows a TecSmarts Technicians
to remotely access your computer to determine the problem
and either repair it or provide advice on what options
are available to fix the issue. When using this service,
you are giving permission to a TecSmarts Technician
to log in to your computer which may contain personal
information.
A TecSmarts Technician will only search your computer
to determine the cause of the problem and will attempt
to limit their interaction with your files to a minimum.
It is your responsibility to ensure all of your files,
especially those containing personal information, are
secure to prevent any type of data loss or corruption.
ii. On-Site Service
Scheduling: Our standard service hours are 8:00am
to 6:00pm Monday - Friday
Additional charges may apply for rapid response services
or service outside of standard installation hours.
Service Jurisdiction: TecSmarts sets the Service
Jurisdiction for each city and Technician. If a location
lies beyond TecSmarts.s standard Service Jurisdiction,
additional trip charges may apply.
An Adult Must Be Present at Residences or Business:
For on-site services, a person of at least 18 years
of age must be present during the entire time period
services are provided. If a TecSmarts Technician arrives
at the scheduled service time and no adult is present,
services will be denied, and a cancellation charge of
$50.00 will be assessed.
(B)
Order Changes/Cancellations
You may cancel your order if you give TecSmarts at least
6 (six) hours notice prior to the scheduled performance
of services. Cancellations must be completed by calling
239-263-9777 or the local scheduled Technician. The payment
amount will be fully refunded in the manner the purchase
was paid.
If you are not satisfied with your service: Please call
239-263-9777 for resolution. We stand behind our Services
for 7 days. If there is a problem with the service we
provided and you notify us within the stated time period,
we will work to remedy your problem quickly and at no
additional cost.
(C) User Responsibility
You understand and agree that prior to contacting or allowing
TecSmarts to perform diagnostic repairs on your computer,
it is your responsibility to back-up the data, software,
information or other files stored on your computer disks
and/or drives. You acknowledge and agree that TecSmarts
shall not be responsible under any circumstance for any
loss or corruption of data and/or software.
(D) Terms and Limitations
TecSmarts and/or its third party service providers reserve
the right to refrain from providing any or all services
ordered and instead refund the customer.s payment, wholly
or in part, on the basis that the minimum system requirement
have not been met or that the technical needs (including
wiring or overcoming physical or technical barriers) or
other requirements of the customer are unusual or extensive
and beyond the scope of this Service Agreement as reasonably
determined by TecSmarts and/or its third party service
providers.
FORCE MAJEURE: If TecSmarts and/or its third party service
providers' ability to render services is impaired by you
or circumstances beyond the control of TecSmarts and/or
its third party service providers, TecSmarts and/or its
third party service providers may choose not to provide
services.
(E) Limitation of Remedy
Under no circumstances shall TecSmarts and/or its third
party service providers be liable to you or any other
person for any damage, including without limitation, any
indirect, incidental, or special or consequential damages,
expenses, costs, profits, lost savings or earnings, lost
or corrupted data, or other liability arising our of,
or related to, the services provided by TecSmarts and/or
its third party service provider or out of the installation,
uninstallation, reinstallation, use of or inability to
use your computer equipment, hardware, peripherals, or
the network resulting from the services provided hereunder.
(F) Jurisdiction
The laws of the State of Florida will govern the TecSmarts
Legal Notices without giving effect to any principles
of conflicts of law.
